    Default Redundancy coming up

    Hi All

    My employer has just announced that our job title and shift pattern is to change and as a result there may be redundancies, They want to go from a team of 11 to a team of 8. And we all have to reappy for these positions. 6 of these positions are basicly the same as the job im doing at the moment just a different title whilest the other two are senior positions requiring management team leader experience.

    My Current job involves working 2 days 2 nights then 4 off. While the new shift pattern which involves working 7 nights at some point during a 6 week period

    The issue is I have Sleep Apneoa which comes under the DDA and have struggled through using CPAP to be able to get back on my normal shift. Occupational health have said someone with sleep apneao shoudlnt do a long strong string of nights. I myself believe due to this disability I couldnt do 7 nights. I emailed my manager with my concerns just before xmas when there was rumours of this upcoming shift but she didnt respond, I also spoke to my teamleader several times regarding this and each time he would say he would ask her to speak to me but still nothing and know we have had this announcement about redundancies.

    I dont know where I stand. I can no longer do my job because they are changing the shift pattern to one I cant do due to this disabilty.

    Any Ideas?

    As I'm sure you know, with a disability you have the right to expect your employer to make reasonable adjustments to enable you to do your job.

    I'd write to your employer formally, applying for the jobs in whatever manner they've requested, but also stating that you have medical recommendations that your disability will not allow you to work the proposed shifts. Say that of course they will be aware that they are required to make adjustments accordingly, and that you sincerely hope and confidently believe that your disability will not be used against you in the selection for the jobs and that selection will be done on merit only.

    That will alert them that you know your rights and that you are on the look out for any suggestion that your disability was in any way a factor.
