    Question Being made redundant but notice period wakes me over to next year's service

    I have worked at the company for 21 days short of 6 years, they have calculated my indended payment based on 5 weeks statutory minimum plus 5 weeks notice but my notice period takes me into 6 years service shouldn't they calculate the payment on 6 years? Any help please

    In practice, working out redundancy pay can be complicated.

    When an employer calculates your notice period for redundancy, the period starts with your first day with your employer, and ends at what is called the "relevant date". This is the day on which your redundancy notice expires, even if your employer has let, or made, you work in the meantime.

    You don't state whether you will be working your notice?

    If the last day that you work is within the 5 years 'completed' service bracket and you have 5 years notice which you are not required to work, then arguably this could be unfair, as had you worked your notice period till your notice expired, your last day of work gave you say 6 years and 10 days service then you would have over 6 years service, making your redundancy entitlement 6 weeks notice pay, 6 weeks statutory minimum).

    I would advise that you speak to your employer about your concerns or follow your employer's grievance procedure to raise the issue.
