Hello everyone,
Wonder if somebody could help with a quick query.
I started my job as a temp through an agency in Oct 2007, after a year I was given a permanent contract for 6 months which was then extended for another 6 months in May of this year. We have since been made redundant and are currently in the consultation period. From the day I started as a temp to my final day I will be 2 days short of 2 years service.
As it stands I will recieve one weeks pay as redundancy as I haven't been a permanent employee for a year. A friend who works in HR said that it's odd they havent protected my continuous service. If they had done my redundancy would increase quite a bit as employees with 18 months service are entitled to 4 weeks pay. I hadn't thought they'd protect my service until she mentioned it and I wondered if any one could comment on this?
Also, they knew they were making us redundant in May yet they renewed my contrat and also took someone else on as a permanent memeber, is it right to do this despite knowing they were making us redundant?
Many thanks for your help in advance.

When you started as a temp, were you employed by the agency or the company you work for albeit on a temporary contract?Clara Buckingham

Thank you for your reply.
As you were employed by an employment agency for the first year unfortunately you only have 1 year service with your employer .
There is no legal obligation for your employer to include the service where you were employed by the agency.
In order to qualify for statutory redundancy pay, you need to have 2 years' continuous service with your employer.
I hope this helpsClara Buckingham
