    Default Unfair process and scores - HELP!!

    Hi,

    I'm now about three weeks into the process and still not been made redundant yet but fear I will be in the next couple of days.
    My first score put me in last position but only by 4 points , I appealed these points as most of what was written by the side of the points was rubbish. I gave a 7 page written reply to this score.
    They agreed to score a second time, at this stage I found out that my qualifications had been missed (lost that page of my CV) and also a later more relevant CV !! After the re-score nothing changed, despite me going from un-skilled to skilled due to their mistake in the qualifications??
    At this stage I also raised a query over the next lowest getting more points than me, he has 'history' of being less than helpful and this was raised by several in the dept. (and verified by HR) on many occasions yet my excellent points score has been beaten by him?
    My full time Union official is now involved and has asked them for the others scores, with names 'redacted'. To date they haven't come up with these.

    So, last week others go that had been earmarked and I'm still there, I then get a letter asking me to yet another meeting and low and behold a THIRD set of scores!!
    The interesting bit this time is that they have increased by score by two, still two lower than I need. We check and can only find one of the criteria has been raised by one point? On checking further we find that the other point was because the first two scores had been added up wrong and not noticed !!
    Now, to me this shows how slack they have been in checking the scores and also points towards them not being bothered as they had the right guy!

    Facts,1) they unfairly scored me due to mistake with CV / Qualifications
    2) They end up rescoring 3 times, first two they don't budge and the 3rd they decide to give me an extra point PLUS find they have added up wrong (not in my favour) the first couple of times.
    3) We believe that the other scores have been unfairly applied also, not taking into account previous issues with another employee, he must have got near perfect scores despite his actions as mine were excellent?
    4) I've been there 3 times longer than the other guy and have no worse a disciplinary or sick record.

    It all seems a stitch up, would the mistakes and comments above be any use to me?

    By the sounds of it you have had 3 consultations and appealed and they have now actually made you redundant? If that is the case then you need legal advice asap, you need to apply to an employment tribunal within 3 months of your termination. Sounds like you have a really good case against them and if you think they have done it fairly at all they haven't. Proving it is tricky but don't give up and let them get away with it because that's what lots of us do. Have you had any problems or issues with you company or with anyone in an influential position higher up than you? I am interested to know!

    Ill tell you a little about myself. I was selected for redundancy in 2007 (unfairly) and I proved them wrong but a stroke of luck saved my job in the end. Another employee pooled with me decided to opt out and the new restructured job was offered to me. We are in 2009 now and they have done it to me again. Unfair selection and again although they have been more objective this time I have yet again proved their incompetence to do the process fairly. Similar to yourself my skills and knowledge was wrong and the whole way they went about coming to decisions and scores was stupid and in my appeal the bigger more important manager adjurned the meeting. And so I face them again tomorrow. They have staff sick records incorrect which I can prove because I have access to pc. And the groupings of supervisors has been stupid and unfair as well, and they know it! There is more but I can discuss another time.

    Anyway the reason I asked you if you have had past problems is because I have. Not my fault but problems. I raised a grievance against 2 managers for bullying in 2005 which one of them was upheld. And since then I have just had problem after problem. The bully got more tactful but ended up with multiple complaints from others and ended up moving else where within the company. Anyway my manager hasn't forgotten all of this and it's clear that they wont leave me alone until am gone, unless I am re-instated tomorrow, that would be funny. I love defying the odds, Oh and winning.

    Hi, great to hear from someone with experience of this kind of thing.

    No, not had a problem, infact less than two years ago I had a substantial pay increase and my manager then supported me all the way. To add to this I've obtained copies of my last two PDR's (appraisals) and they are great, no mention of any problems.
    The last appraisal was only 3 months ago and mentions none of the issues he has now marked me down on?????

    The whole thing is so 'subjective' and any negatives raised towards me can be countered by written appraisals etc.
    The next lowest guy has had complaints about his attitude to work and the dept several times, this can be verified yet he scored higher than me despite mine being very good?? Also I've been there 3 times longer.

    By the way, yes I've now been made redundant.
    I've had about three consultation meetings arguing the scores, the union have also asked for the scores of the others (names deleted) and the company has refused.
    I've already put in for an appeal in writing, the second they gave me notice of redundancy I 'swapped' with a pre-prepared letter lol.

    The Full Time Union official is now taking it over from the rep., he has loads of experience in this sort of thing and also legal backing/advice too.

    Sounds like the company are on very dodgy grounds to me. I have had my appeal today and to my suprise it was a very positive meeting and they know now if it goes to a tribunal they will loose. My Union official said that the company would not waste their money on a barrister because they have failed to do it fairly. But I know these companies all too well and they may rely on me accepting a financial offer but little do they know I am determined to see it through.

    You follow it throw all the way! Even though you might not want to hear it by the sounds of it someone has wanted you out. Things don't add up for a reason and them refusing to disclose information is very naughty of them. Treading on thin ice.

    Hi again,

    Today I got a letter regarding the date of the appeal (next week) and then followed by a phoncall telling me that's been camcelled and they would re-arrange and send me a fresh date !!
    In with this letter was a copy of the other peoples scores, 2 of them. All the details are hidden but the scores and totals are there. Now I know the guy I'm 'competing' against had 84 in the beginning (I had 80). Mine rose to 82 because of a mistake in the original two scorings and also I gained one extra through arguement. Well, low and behold his '84' has also risen and now stands at 85 !!! Talk about moving the goalposts !

    My Union rep is disgusted and says it gets clearer every time that they wanted me to go and is such a stitch up. Spoke to the full time official also today and he says that in his opinion we have a 'very strong case'.
