Hi
I worked for my employer 3yrs (part of a continous employment from the liquidated previous company). The company employed 5 others - one of those being there 25days before my redundancy (Admin/Production).
I was made redundant verbally and given a letter on 26/06 and told not to return to my work. My role was General Manager, admin. The owners wife was on Payroll (admin) but purely for his tax avoidance purposes.
My contract stipulates that the employer must give 2mth notice period.
I requested my statutory redundancy pay, 2mths notice pay, holiday pay, last weeks wages and P45. My calculations came to owing £4963, due to PILON.
30/6 I was told I would be paid in £500 instalments, and was paid £500.
1/7 I requested all due (above), but was told no instalments only.
10/7 After receiving nothing more I sent an email requesting the items again - no reply. I then sent a Modified Grievance Procedure letter to request a meeting regarding the issues. Then some hours after that £151.39 was paid into my account. No explanations.
Can someone be sacked for gross misconduct after being made redundant? Not that I have but I'm at a loss as to the reasoning here. Can deductions be made without any explanation?
Thank you for anyones help on this, as its extremely stressful and worrying.

Non Payment of Redundancy

Hi
Your redundancy payment should be paid as soon as possible after the last date of your employment. You shouldn't have to claim redundancy pay from your employer, they should automatically pay it to you.
If your employer does not give you redundancy pay when you are entitled to it you should write to them asking for payment. If your employer still refuses to pay you or cannot make the payment you could make an appeal to an Employment Tribunal.
If you employer has paid you PILON and you have been terminated from the company on the grounds of redundancy then they can't then re-dismiss you.
I hope this helps.Clara Buckingham
