    Question Changing your mind on voluntary redundancy ?

    Advise please. I have recently requested to take voluntary redundacy from my company, and have been accepted and given a leaving date of the 31st July 2009.
    However, there has been an unexpected change in my circumstances in the last few days and ideally I would now like to recind the offer and remain in employment.
    Am I legally able to do this, or would any decision to allow me to recind my offer be down to the goodwill of my employer ??

    Hi

    The ultimate answer to your question really depends upon whether you have been issued with formal notice of redundancy. The fact that you have been issued with a leaving dates indicates that you have. If you haven't been served with formal notice, you could contact your employer and ask for it to be retracted. Some companies allow staff to reconsider volunteering, and then retract their applications by a set date

    There is no legal requirement for your employer to allow you to retract your application once you have been issued with formal notice of termination.

    It would be worth checking any policies that your employer may have regarding withdrawal of voluntary redundancy.

    It would be a good idea to contact your employer in person and in writing to explain your reasons for wishing to retract your notice. It will be down to the goodwill of your employer to decide according.
