    Angry Made Redundant then they employ a temp to do some of my old work

    I was made redundant 4 months ago. The company was downsizing every department and our time came and I was the one to go.
    The redundancy procedure seemed ok. I was assessed for my skills along with my colleague and I was deemed to be the least skilled to do the job.
    I had been with the company for 11 years and she has worked with us for about 4 years. I was given a redundancy payout and did not have to work the notice.
    I have recently found out that 3 1/2 months after I had left, they employed a temp to work in the department I had left. This temporary worker has been doing some of the work I was doing but not all and I think they have brought her in as an assistant rather than give her my old job title. I also think they have recruited her from the same agency I am registered with as we used this agency all the time for temp workers and who I was advised to join after being made redundant.

    Am I right in thinking that because they employed someone within 6 months they have broke some law?
    Should I have had first refusal on the job?
    Should I seek legal advice?

    Hi

    I am sorry to hear about your situation although I'm afraid your ex-employer is not legally obliged to offer work to you.

    From your post, it sounds as though there has been a restructure and the company has elected to hire a temporary agency worker to undertake some duties.

    The time limit to claim for unfair dismissal for redundancies prior to April 2009 is 3 months so I am afraid this period has passed. Therefore it would be inadvisable to seek legal advice for this situation.
