I have closed my business an placed a employee on 'garden leave' for the notice period, as per terms and conditions of employment. They will receive weekly pay for this period followed by a redundancy payment.
The employee is advertising as being self employed and is working in this capacity during their notice period.
Does this mean that they have left my employment?
Am I entitled to withold future notice period payments?
By working as self employed are they still entitled to redundancy payment at the end of their notice period?
