    Default Voluntary Redundancy and what to put in writing

    Hi, during the consultation process an employee requested VR and I have accepted it and agreed an enhanced package.

    I would like to put something in writing to agree this but also include a couple of clauses relating to stopping the employee trying to recruit any remaining staff within 6 months etc. Can I do this or should this sort of clause only go in a compromise agreement?

    Should I just stick to a letter confirming the VR as I would had it not been voluntary?

    If you wish to set conditions on a voluntary redundancy then you may do so. I would advise that you get legal advice as to the wording, and it may be worth consdiering a compromise agreement although the latter isn't absolutely required - but it does protect your position better.
