council redundancies

    Angry council redundancies

    Hi everyone.
    I have a job with a local council as a finance assistant. On the restructuring graph it shows my current post as unaffected, (same job, post number and description)
    However, I have received a letter stating that I must re apply for my job as there are 20 assistants but they only need 19. Some people have been sideways slotted back into their current jobs without having to re apply.
    I have a contract of employment which I have not broken the terms of for the post I currently hold. If that post is unaffected by restructure, how can I be made redundant from that post. Surely if the council say I’m redundant and then give the job to someone else isn’t that breach of contract on their part? I thought that you could only be made redundant if your post or job was dissolved or changed.
    Also why do some people have to re apply for jobs and others (mainly at the top end, have neatly slotted back into a job with no selection process. Surely thats unfair.
    Is there a case for tribunal here?
    Any info would be gratefully received as I don’t really know whether I should do nothing and then when they say Im out fight them over it ( wrongful dissmisal etc) or would they win anyway and maybe I should just re apply.

    Unless they do something wrong in the future - they haven't yet done anything to give you a case. It's very simple - there is a redundancy situation because there are 20 posts and they are reducing the number of posts by 1, so the 20 people holding those posts must compete for the 19 jobs. This is entirely fair in law. The employer is expected to pool all posts and people that are the same or broadly similar, and simply because what you think of as "your job" (and it isn't - it's the employers job!) will remain at the end of the process does not mean that you will be in it - or in any job. That is the purpose of the process - to decide who goes. It isn't a breach of contract, and it is entirely fair.

    Slot-in's can only occur where there is a compatible new job with the old job and there is no competition - in other words when the number of people and the number of roles match. In your case this has not happened - there are 20 people and 19 jobs.

    That answered my question exactly thankyou very much.
    Also if I now re apply for my job and lose does it mean that I wont get any redundancy payment.

    No. If you apply for your job and don't get it you will be eligible for redundancy pay - if you are made redundant. Most councils operate redeployment policies and not getting one of the 19 posts available would not mean that you were redundant. Only at risk.
