Notice your employer must give you

Your employer is required to give you a statutory minimum period of notice of termination of employment regardless of what your contract of employment states. The length of notice is dependent upon on how long you have worked for your employer:

  • One week for between one month and two years continuous work
  • One week per year (max 12) for two years or more continuous work



Notice Pay

As an alternative, if you are not required to work your notice period, payment in lieu of notice (PILON) should be paid in addition to your statutory redundancy payment.

This may be set out in a clause in your contract or you can agree an amount with your employer and will usually cover the amount you would have earned during your notice period. Contractual PILON will attract tax and NI payments while non-contractual PILON almost never do.
